My name is ______, and I, petition the court to consider the following facts: ________ (ex-spouse name) and I were married on ______ (date). If the children live with me, they will be able to stay in the same home and go to the same school. But they will only be able to see __________ during supervised visits. This is because he has anger issues and the court has ordered him to go to anger management classes.

My name is _______ and I am writing to ask the court to grant me full custody of the children and supervised visitation for ________ (name). We were married _________ and our marriage ended in _________. Our first child was born on _______, upon which we faced several turbulences in our marriage. John Smith has paid the agreed-upon child support, but he has never made an active effort to meet the child or take initiative in building a relationship. While the reasons for the divorce are enclosed in the file for divorce, I would like to point out that ________’s infinity created an unsafe environment for both me and our child.

I am living in my own home and paying the mortgage and utilities myself. Based on this information, I believe it would be in the best interests of the children to live with me full time. If the children live with me, they can stay in the same home, go to the same school, and do the same activities as before. I will ensure that I provide them with the same life as they were living with their father. Supervised visits will let the child see______, but with less risk of being hurt by his emotional problems. The child is young and does not understand complex affairs, of which _______ has had plenty.

In no way do I intend on keeping the father from the child, but I do think that for the while the child deserves to stay away from emotional volatility.

Thank you for your consideration.

SAMPLE CHILD CUSTODY DECLARATION LETTER

[Full name]
[Street address]
[City, state, zip code]
[Current date]
To the honorable Judge _
John Smith and I were married in July 2012. We had our first child together in March of 2013,
and another in July 2015. I am asking for physical custody and supervised visitation for John
Smith.
Since our separation three months ago, the children have been living with me exclusively. John
Smith has paid agreed upon-child support. He has only seen the children on one occasion. I am
living in the family home and paying the mortgage and utilities. John Smith is staying in an
unknown location.
If the children live with me, they will be able to maintain the home they are used to, and attend
the same school and activities as they have in the past. Supervised visitation will allow them to
have a relationship with John Smith while reducing their risk of being impacted by his anger
issues. Evidence of these anger issues includes Mr. Smith being ordered into anger
management classes by the court in January of 2017, and the issuance of a restraining order in
September of 2018.
Given the information above, I am asking the court to order that the children live with me
full time and that John Smith receive supervised visitation at regular intervals. I would like
support to continue to be paid as it has been.
Sincerely,
